By purchasing products/services from Custom Canvas Limited you (the Customer) agree to the following:
INDEMNITY IN FAVOUR OF CUSTOM CANVAS
The Customer confirms that they are the true and lawful owner of the photos/images
The Customer as the true and lawful owner of the photo/images confirms that they have the full power and authority to engage Custom Canvas to print the photo/image.
The Customer agrees to indemnify and at all times to keep the indemnified Custom Canvas and its Directors from all actions, proceedings, claims, demands, expenses and other liabilities of any nature (whether breach of copyright or otherwise) which may arise as a result of Custom Canvas printing the photo/images provided to them by the Customer
PERMISSION TO EDIT
The Customer gives permission for Custom Canvas to print the image supplied AND permission to alter the image as they see necessary.
In particular, Custom Canvas has sole discretion to gallery wrap or add a solid colour to the sides of the canvas frame if the Customer has not clearly stated their preference in writing at the time of placing the order.
LOSS AND/OR DAMAGES OF MEDIA
Custom Canvas Limited, its Employees and Associated Parties are NOT responsible for any loss or damages, of any kind, to any of the Customer's media while in their possession and/or while in transit, including but not limited to consequential losses.
CANCELLATION
An order can be cancelled by the Customer by notifying Custom Canvas either by email or phone and the cancellations is accepted on receipt of that notification. The Customer may be billed for any time, costs or materials that have already been expended on the project by Custom Canvas and this may include the full cost of production.
Custom Canvas can cancel the order for any reason and maintains the right to refuse custom to any individual or other entity on any grounds.
An order is deemed cancelled if any of the following occur:
1. The Customer does not make sufficient contact within 3 days of placing the order.
2. The Customer does not pay within 5 days of placing the order.
3. No or an inadequate street delivery address is supplied and reasonable steps to contact the Customer are unsuccessful after 7 days
OWNERSHIP OF GOODS
Goods remains the property of the Custom Canvas until paid in full.
Goods from cancelled orders can be retained, sold or disposed of at the Supplier's discretion if:
1. The order remains unpaid after 30 days of placing the order, and
2. Reasonable steps have been taken to recover monies owed within that time period.
PAYMENT OF GOODS
The Customer agrees to pay the full amount owed as it shows on the online order confirmation page OR as confirmed by Custom Canvas via email or phone. The Customer waives all claims of ownership until payment has cleared in a bank account nominated by Custom Canvas and the canvas has been despatched.
Payment is due prior to delivery. Delivery made prior to payment does not negate Custom Canvas' ownership of the goods.
RETURNS
Custom Canvas does not accept returned canvases if you have simply changed your mind. Canvases with printing imperfections will be replaced or refunded at Custom Canvas’ discretion. Custom Canvas reserves the right to charge for re-posting returned orders which have been especially produced to meet your requirements.
DAMAGE IN TRANSIT
Items damaged in transit can be replaced if you notify a Custom Canvas representative immediately and do NOT sign for the delivery. If there is any damage to the packaging when the canvas arrives do not sign for it - email or call and let us know as soon as possible. If you do sign for it then we cannot make a claim with the courier company.
TRADE
These terms also apply to our valuable trade customers, in addition to those specified in the Trade Terms.
DEFINITIONS
'Media' and 'image' refer to the visual article(s) submitted for Custom Canvas to reproduce. It includes but is not limited to storage devices such as CDs and flash drives, negatives, slides, photographs, artwork and prints and encompasses digital and paper medium.
An 'order' is all work requested by the Customer whether placed via a website order page, email, phone or in person. An order is an express request for Custom Canvas to complete the work unless stated otherwise.
'Goods' refer to printed canvas material produced by Custom Canvas as a direct result of an order.
